Illinois does not use a standard percentage sales tax for private party vehicle sales like it does for dealership purchases. Instead, you must complete Form RUT-50 (Private Party Vehicle Use Tax Transaction Return). The tax amount is generally determined by the age of the vehicle and the purchase price. You must submit this form and pay the tax to the Secretary of State's office when you apply for the title, not to the seller.
Generally, no safety inspection is required for a vehicle transfer in Illinois. However, if the vehicle is registered in specific areas (primarily the Chicago metropolitan area and parts of the Metro East St. Louis area), it may be subject to emissions testing. While the seller is not legally required to provide a passing emissions test to sell the car, you will not be able to renew the registration if it fails. It is wise to check the vehicle's testing status before buying.
While the signed title is the primary legal document, a Bill of Sale is highly recommended and acts as your receipt. It should include the vehicle’s year, make, model, VIN, purchase price, date of sale, and the names, addresses, and signatures of both the buyer and seller. Keep this for your records, especially to verify the purchase price for the RUT-50 tax form.
You have 20 days from the date of purchase to submit your application for title and registration to the Illinois Secretary of State. If you miss this deadline, your tax liability may increase, and you could face penalties.
To complete the title transfer and registration, bring the following:
The original Illinois title, properly signed by both parties.
A completed Form RUT-50 (tax return).
A completed Application for Vehicle Transaction (VSD 190), which can be filled out online and printed or done at the facility.
Your valid Illinois driver's license or ID.
Proof of Illinois insurance.
Payment for the title fee ($165), registration fee ($151 for standard plates), and the applicable tax.
