When buying a car from a private seller in Indiana, obtaining the original Certificate of Title is the most critical step. The seller must complete the "assignment of title" section on the back, filling in the date of sale, purchase price, and current odometer reading. Both you (the buyer) and the seller must sign and print your names. If the title is from another state or an older Indiana title without these fields, you may need a separate Odometer Disclosure Statement (Form 43230).
Indiana generally does not require safety or emissions inspections for vehicle registration in most counties. However, there are two important exceptions:
VIN Inspection: If the vehicle has an out-of-state title, you must have a VIN inspection performed by a law enforcement officer or at a BMV branch before you can title it in Indiana.
Emissions Testing: Only residents of Lake and Porter counties are required to pass emissions tests every two years for most vehicles.
While the signed title is the primary document, a Bill of Sale (Form 44237) is highly recommended and sometimes required. The BMV may require a bill of sale if the selling price written on the title seems lower than the fair market value, or if the title does not have a specific line for the purchase price. It acts as your official receipt and protects both parties.
You have 45 days from the date of purchase to title and register the vehicle at an Indiana BMV branch. If you fail to apply for the title within this 45-day window, you will be charged a late fee.
To successfully transfer the title and register the vehicle, bring the following:
The original Indiana title, properly signed by both the buyer and seller.
A completed Bill of Sale (Form 44237), if applicable.
Physical inspection of a vehicle or watercraft (Form 39530) if the title is from out-of-state.
Proof of Indiana insurance.
Your valid Indiana driver's license or ID.
Payment for the 7% sales tax, title fee, and registration fees.
