No. In Florida, the license plate (tag) belongs to the seller, not the vehicle. You must remove the license plate before the buyer drives the vehicle away. You can transfer this plate to a replacement vehicle or turn it in to a tax collector's office to cancel the registration. If you leave the plate on the car, you could be held liable for tolls, tickets, or crimes committed with the vehicle.
To legally release yourself from responsibility, you must file a Notice of Sale (Form HSMV 82050). You should submit this form to your local tax collector's office immediately after the sale. This document informs the state that you have sold the vehicle, protecting you from civil liability if the new owner gets into an accident before they transfer the title.
Florida is one of the few states that does not require a periodic safety inspection or an emissions (smog) test for private vehicle sales. You can sell the vehicle in "as is" condition.
While the title is the primary legal document, a Bill of Sale is highly recommended for your records. It serves as proof of the date and price of the transaction. In Florida, the Notice of Sale (Form HSMV 82050) effectively functions as a bill of sale for the state's records, but writing up a simple receipt with vehicle details and sale price for both parties is a smart move for private sellers.
You do not collect sales tax. The buyer is responsible for paying the sales tax (6% state tax plus any discretionary county surtax) when they go to the tax collector's office to transfer the title and register the vehicle in their name.
Many Florida vehicles have electronic titles (e-titles) and no paper document exists. Before you can sell your car privately, you must request a paper title be printed. You can do this online through the FLHSMV website or visit a local tax collector's office. You cannot sign ownership over to a buyer until you have the physical paper title in hand.
On the face of the paper title, locate the "Transfer of Title by Seller" section. You must:
Enter the odometer reading.
Print the buyer's name and address.
Enter the date of the sale and the selling price.
Sign and print your name.
If there are two owners joined by "AND" on the title, both must sign. If joined by "OR," only one signature is required. Important: Do not use correction fluid or cross out mistakes, as this voids the title.
