To transfer ownership, you must properly complete the "Assignment of Ownership" section on the back of your Certificate of Title. You will need to:
Sign and print your name exactly as it appears on the front of the title.
Enter the buyer's full name and address.
Write down the current odometer reading. Federal law requires this for vehicles less than 20 years old.
Fill in the date of the sale and the purchase price.
If the title shows two owners joined by "AND," both must sign. If it says "OR," only one owner needs to sign. Never use correction fluid or cross out information, as this will invalidate the title.
If you can't find your title, you must apply for a duplicate by completing Form 400 (Application for Certificate of Title/Registration) and paying a fee to the SCDMV. If you have an outstanding loan on the car, the lienholder’s name will be on the title. You must pay off the loan in full. The lender will then release the lien, allowing you to get a clear title to sign over to the new owner.
No. As a private seller, you do not collect sales tax. However, the buyer will pay an Infrastructure Maintenance Fee (IMF) when they title and register the vehicle. This fee is 5% of the purchase price, but it is capped at $500. The buyer pays this directly to the SCDMV.
While the signed title is the official transfer document, a Bill of Sale is highly recommended. It serves as a receipt and provides a detailed record of the transaction. You can use the SCDMV Form 4031 (Bill of Sale). This form should include the vehicle information (VIN, year, make, model), the sale price, the date, and the names and signatures of both you and the buyer. Keep a copy for your records.
No. South Carolina does not require safety or emissions inspections for private vehicle sales. Cars are sold "as-is."
