To legally transfer ownership, you and the buyer must complete the "Assignment of Ownership" section on the back of the Certificate of Title. You need to:
Fill in the buyer's full name and address.
Record the exact odometer reading (without tenths of a mile).
Enter the date of the sale and the purchase price.
Sign and print your name.
Crucially, the title transfer must be notarized. Both you and the buyer must sign the title in the presence of a notary public. Do not sign it beforehand.
If your title is lost or damaged, you must apply for a duplicate title from the OMV before you can sell the car. If you have an outstanding loan, the lienholder’s name will be on the title. You must pay off the loan in full. The lender will then provide you with the properly released title or a separate lien release document that you can use to obtain a clear title.
Yes. Louisiana law requires that a vehicle has a current, valid safety inspection sticker to be legally sold. It is the seller's responsibility to ensure the vehicle has a passing inspection sticker at the time of sale. The buyer cannot legally drive the vehicle off your property without one.
Yes. A notarized Bill of Sale is required for a private vehicle sale in Louisiana. The OMV provides a specific form, the Vehicle Application (Form DPSMV 1799), which serves as both the application for title and the bill of sale. This form must be completed and notarized. It needs to include:
The vehicle's year, make, model, and VIN.
The purchase price and date of sale.
The full names, addresses, and signatures of both the seller and the buyer.
Both parties should keep a copy of the notarized document for their records.
The buyer is responsible for paying all applicable state and local sales taxes. Private sellers do not collect sales tax. The buyer will pay the tax directly to the OMV when they transfer the title and register the vehicle.
In Louisiana, the license plate belongs to the seller. You must remove your license plate from the vehicle before the buyer drives away. You can then transfer the plate to another vehicle you own, or you can destroy it or turn it in to the OMV.
Always prioritize your safety. Arrange to meet buyers in a public, well-lit, and busy location. The parking lot of a police station, a bank, or a major retail center are all excellent choices. Never invite a stranger to your home. When it's time for a test drive, always check for a valid driver's license and accompany the buyer on the drive.
