To legally transfer ownership, the seller must sign the back of the original Georgia Certificate of Title. Every owner listed on the front must sign as a seller. Bring your properly signed title to the Clayton County Tax Commissioner’s Office to complete the transfer and put the car in your name.
You will be responsible for paying standard title and registration fees, plus the TAVT, when you put the car in your name. The state calculates the TAVT based on the fair market value of the vehicle determined by the Department of Revenue, not the cash amount you handed the seller.
A lien means a bank or lender still has a financial claim on the vehicle. Look at the front of the Georgia title to find any active lienholders. If you see a lender listed, the seller must provide you with an official paper lien release document from that bank before you can get a clear title in your name.
If the seller cannot find the paper title, they must apply for a replacement title (Form MV-1) from the Georgia Department of Revenue before they can legally sell the vehicle to you. Do not exchange money for a car without receiving a properly signed, physical title in your hand.
